Terms & Conditions

Maldives Post always ensures that every needed measure is taken into consideration of safeguarding and delivering the goods to the recipients without damaging or either occurring any kind of loss.

The information contained in this document provides only a basic outline of your Dhahanaa protection.

Voyage

From the time the subject matter insured is delivered to Maldives Post designated office (as the case may be) to address as stated in the consignment note.

Important Notice: Maldives Post does not insure certain items. Please refer to the goods excluded list.

On all general merchandise but excluding items listed under lists A, B and C:

The Post Dhahanaa Coverage Does Not Cover the Following Situations and Events:-

  1. Any loss of profits, business or anticipated savings, or any indirect or consequential loss or damage, or any loss or damage caused by delays;
  2. Any loss or damage arising from or in connection with:
  • Maldives Post’s failure to perform any of its obligations hereunder if such failure is the result of circumstances outside its control including but not limited to the outbreak of war, any governmental act, explosion, accident, civil commotion, riot, industrial dispute, strike, lockout, stoppages or restraint of labour from whatever cause whether partial or general, weather conditions, traffic congestion, mechanical breakdown, obstruction of any public or private road or highway or any other force majeure, fire, floor or any other act of God;
  • any defect (including latent or inherent defects) in respect of the shipment, even if known to Maldives Post when Maldives Post accepted it;
  • the shipper’s acts or omissions, including but not limited to defective, insufficient or improper packing, security or addressing;
  • any action or omission by anyone other than Maldives Post including but not limited to:
  1. you, as the sender of the shipment;
  2. the addressee;
  3. an interested third party;
  4. customs or other government officials; and
  5. the carrier or other third party contracted by Maldives Post to serve locations that Maldives Post does not serve directly.
  • electrical or magnetic damage to, or erasure of electronic or photographic images or recordings;
  • any loss of secrecy in communication arising from the use of the services;
  • the hazardous, fragile or brittle nature of the mechanical derangement of the items shipped;
  • any consequences of delay or confiscation by any competent authority as a result of the discovery of prohibited contents;
  1. Any loss or damage, delay or non-delivery of the article arising from the detention of the shipment by the customs or any government authority of the sending country and destination country.
  2. Please note that Maldives Post shall not, in the provision of Post Dhahanaa Coverage, be liable for the following key exclusions:
  3. Rusting, oxidation, discolouration and corrosion of the article
  4. Scratching, denting, bending and chipping of the article unless caused by fire, explosion, overturning and collision of the conveyance
  5. Loss, damage or expense attributable to wilful misconduct of the Covered Customer
  6. Ordinary leakage, ordinary loss in weight or volume, or ordinary wear and tear of the article covered by Post Dhahanaa Coverage
  7. Loss, damage or expenses caused by insufficiency or unsuitability of packing or preparation of the article covered by Post Dhahanaa Coverage (for the purpose of this Clause (v) “packing” shall be deemed to include stowage in a container or liftvan but only when such stowage is carried out prior to the Post Dhahanaa Coverage coming into effect or by the Covered Customer or their employee)
  8. Loss, damage or expense caused by inherent vice or nature of the article covered by Post Dhahanaa Coverage
  9. Loss, damage or expense proximately caused by delay
  10. Loss, damage or expenses to the article arising from insolvency or financial default of the owners, managers, charterers or operators of the vessel transporting it
  11. Deliberate damage to or deliberate destruction of the article covered by Post Dhahanaa Coverage or any part thereof by the wrongful act or any person or persons
  12. Loss, damage or expenses arising from the use of any weapon of war employing atomic or nuclear fission and/or fusion or other like reaction or radioactive force or matter
  13. Loss, damage or expenses arising from unseaworthiness of vessel or craft
  14. Loss, damage or expenses arising from unfitness of vessel craft conveyance container or liftvan for the safe carriage of the article covered by Post Dhahanaa Coverage where the Covered Customer or their employee are privy to such unseaworthiness or unfitness, at the time the article covered by Post Dhahanaa Coverage is loaded therein
  15. Loss, damage or expenses caused by war, civil war, revolution, rebellion, insurrection, or civil strife arising therefrom, or any hostile act by or against a belligerent power
  16. Loss, damage or expenses caused by capture seizure arrest restraint or detainment (Piracy excepted), and the consequences thereof or any attempt thereat
  17. Loss, damage or expenses caused by derelict mines, torpedoes, bombs or other derelict weapons of war
  18. Loss, damage or expenses caused by strikers, locked-out workmen, or persons taking part in labour disturbances, riots or civil commotions
  19. Loss, damage or expenses caused resulting from strikes, lock-outs, labour disturbances, riots or civil commotions
  20. Loss, damage or expenses caused by terrorist or any person acting from a political motive
  21. Loss, damage or expenses due to radioactive Contamination, Chemical, Biological, Bio-chemical and Electromagnetic Weapons
  22. Loss, damage or expenses due to cyber Attack

For the purpose of this Clause D, the term “Covered Customer” shall mean the Maldives Post customer who has purchased the additional Post Dhahanaa Coverage when purchasing the services.

Period of Cover

All claims must be submitted in writing to Maldives Post within thirty (30) days, from the date that the shipment was delivered to the customer. Any damage or missing of items should be report immediately upon delivery of the package. Failing which Maldives Post shall have no liability whatsoever. Minimizing losses The Dhahanaa of the subject matter continues, unless provided otherwise in the policy, during the ordinary course of transit, and terminates either on delivery to the address stated in the consignment note or until such other period stipulated in the policy, whichever shall first occur.

The signature on the “Proof of delivery” copy of the consignment note and/or any such document issued by the Maldives Post or the destination country’s delivery agent shall be conclusive proof of safe delivery.

Procedure for Claims

  1. All enquiries relating to claims are to be submitted to customer service via +960331555, +9603324447 during service hours or email to info@maldivespost.com.
  2. When submitting the claim, all relevant documents must be enclosed, including but not limited to the following: -

2.1 Consignment note/tracking information and payment advice;

2.2 Original invoices or purchase receipts of the subject matter insured;

2.3 Survey report or other documentary evidence showing the extent of the loss or damage of the subject matter insured;

2.4 Original repair bills/replacement invoices;

2.5 All correspondence exchanged with any third party responsible or potentially responsible for the loss or damage of the subject matter

  1. You and/or your addressee shall not give clean receipts except under written protest, when there is apparent damage (including any damage to the packing) to the subject matter insured.

Complying with the above procedure shall be condition precedent to Post Dhahanaa.

Premium, Limits of Liability & Excess

With effect from 09th October 2019.

  1. All premiums [i]payable will be based on 3% of the declared item value subject to a minimum premium# of MVR 150 for each consignment note.
  2. Limits of liability of each consignment note will be MVR 25,000 or the declared value on the consignment note whichever is low. The basis of valuation of any loss or damage to the subject matter or any such expense incurred related thereto is set out in the policy.
  3. Nil excess will apply for each consignment note.

Governing Law

Post Dhahanaa is subject to and shall be governed by laws of Maldives. Any claim or other dispute hereunder shall be determined exclusively by the courts of Maldives.

Duty of Disclosure

In addition to providing all basic information necessary to enable Maldives Post to place the risk, you must ensure that you are complying with your legal duty of disclosure of all material matters relating to the risk. In particular, you must satisfy yourself as to accuracy and completeness of the information you provide to Maldives Post.

In this respect, you must provide all information relating to the risk, whether favourable or not, which would influence the judgment of a prudent insurer in determining whether he will take the risk, and, if so for what premium and on what terms.

If you do not disclose all such information, Maldives Post has the right to void the Post Dhahanaa contract from its commencement, which may lead to claims not being met.
